Privacy Policy

SECTION 1 - General Information

1.1 This Privacy Policy governs the manner in which American Auto Donation collects, uses, maintains, and discloses information collected from users (each, a “User”) of the americanautodonation.org website (“Site”) and phone calls. This privacy policy applies to the Site, phone calls, communications, and all products and services offered by American Auto Donation. By using this Site you consent to the collection and use of information by American Auto Donation as specified in this Privacy Policy and agree to be bound by the provisions set forth in this policy.

SECTION 2 - How We Use and Collect Your Information

2.1 When you visit americanautodonation.org, we may collect personal identification information from Users in a variety of ways, including, but not limited to, when Users visit our site, fill out a donation form, and in connection with other activities, services, features, or resources we make available on our Site. Users may be asked for, as appropriate, name, email address, mailing address, phone number, and vehicle details. Users may, however, visit our Site anonymously. We will collect personal identification information from Users only if they voluntarily submit such information to us. Users can always refuse to supply personally identifiable information, except that it may prevent them from engaging in certain Site related activities.

2.2 When you browse our Site, we also automatically receive your computer’s Internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

2.3 Our Site may use “cookies” to enhance User experience. User’s web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. Users may choose to set their web browser to refuse cookies or to alert you when cookies are being sent. If they do so, note that some parts of the Site may not function properly.

2.4 We may collect non-personal identification information about Users whenever they interact with our Site. Non-personal identification information may include the browser name, the type of computer and technical information about Users’ means of connection to our Site, such as the operating system and the internet service providers utilized and other similar information.

2.5 We do not sell, trade, or rent Users’ personal identification information to others with the exception of the charity to which you donate your vehicle to. Your contact information, vehicle information, and sale information is shared with our charities, as you are agreeing to donate your vehicle to their cause. We may share generic aggregated demographic information not linked to any personal identification information regarding visitors and users with our business partners, trusted affiliates and advertisers for the purposes outlined above.

2.6 If a Donor’s vehicle sells for more than $500 an IRS form 1098c will be provided to the Donor only if the donor provides American Auto Donation with their Social Security Number (SSN.) Donor’s SSN is required by the IRS’s tax law for vehicle donations, and for donors to receive a tax deduction greater than $500. American Auto Donation protects the privacy of donors. Donor information is not given to any organization except the IRS, as required by law, and the donor designated charity. Donor names and addresses, excluding Social Security Numbers, are shared with the donor designated charity.

2.7 We use Sentry.io, a third-party service, for error tracking and session replay. This service collects information about your use of our Site, including error logs, performance data, and session replay data (such as mouse movements and clicks). We use this data to identify and fix technical issues, improve Site performance, and enhance user experience. The data is transmitted securely, stored on Sentry.io’s servers, and retained before automatic deletion.

2.8 Users have the right to request access to or deletion of their data collected by Sentry.io, and may opt-out of session replay recording. To exercise these rights or for more information, please contact us using the information provided in Section 8.

2.9 We encourage Users to review Sentry.io’s privacy policy for more information about their data handling practices.

SECTION 3 - Consent

3.1 When you provide us with personal information to complete a donation, we imply that you consent to our collecting it and using it for that specific reason only.

3.2 If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent or provide you with an opportunity to say no.

3.3 If after you opt-in, you change your mind, you may withdraw your consent for us at anytime, by calling us at (866) 639-9493.

SECTION 4 - Age of Consent

4.1 By using this site, you represent that you are at least the age of majority in your state or province of residence.

4.2 Protecting the privacy of the very young is especially important. For that reason, we never collect or maintain information at our Site from those we actually know are under 13, and no part of our Site is structured to attract anyone under 13.

SECTION 5 - Disclosure

5.1 We may disclose your personal information if we are required by law to do so or if you violate our Terms and Conditions.

5.2 You agree that the information you provide is accurate and truthful to the best of your knowledge.

5.3 Once you leave our Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Site’s Terms and Conditions.

5.4 The logos and images of American Auto Donation and other companies used on this site are protected by the copyright and trademark laws of the United States of America.

5.5 American Auto Donation gives no tax advice. It is solely your responsibility to report vehicle value and your tax status. More information about deducting vehicle donations is available from the IRS at http://www.irs.gov.

SECTION 6 - Security

6.1 To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

SECTION 7 - Changes to this Policy

7.1 We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the Site. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

7.2 If our Site is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to serve our donors and donees.

Terms & Conditions

These Terms and Conditions (“Agreement”) govern the donation of a vehicle (“Vehicle”) to the recipient organization (“Organization”) by the donor (“Donor”). By donating the Vehicle, the Donor agrees to be bound by these Terms and Conditions.

SMS Communication Consent

By providing your phone number and contacting us to request our vehicle donation services, you expressly consent to receive SMS text messages from us for purposes related to your inquiry, including service updates, scheduling, and general communication regarding your car donation. Message and data rates may apply. You may opt out of receiving text messages at any time by replying “STOP” to any message received.

E-Sign Consent

By clicking any submission button on this site, which you adopt as your electronic signature, you consent and agree to the following:

  1. We may provide you with any disclosures required by law, as well as other information about your legal rights and duties, electronically.
  2. Your electronic signature on agreements and documents has the same legal effect as if you signed them in ink.
  3. We may send all required communications and disclosures—including this E-Sign Consent, the SMS Communication Consent, the Privacy Notice, and these Terms and Conditions (collectively, “Disclosures”)—to you electronically by: (a) email; (b) a link to a web page provided in an email at the time the information becomes available; or (c) to the extent permitted by law, a web page we designate in advance for that purpose.
  4. If you would like a paper copy of any Disclosures, you may print or download them for your records at any time.
  5. This consent applies to all current and future Disclosures and transactions associated with your vehicle donation and your use of this site, unless you withdraw your consent in advance by contacting us directly.

Vehicle Donation Process

1.1 The Donor must provide accurate and complete information about the Vehicle, including but not limited to its make, model, year, mileage, and condition.

1.2 The Donor must be the legal owner of the Vehicle, or have the authority to donate it on behalf of the legal owner.

1.3 The Donor must ensure that all liens or encumbrances on the Vehicle are fully disclosed to the Organization prior to donation.

Vehicle Transfer and Ownership

2.1 The Donor acknowledges that the title and ownership of the Vehicle will be transferred to the Organization upon acceptance of the donation.

2.2 The Donor agrees to sign and deliver all necessary documents required to transfer the ownership of the Vehicle to the Organization.

2.3 The Donor acknowledges that the Organization may reassign, sell, or otherwise dispose of the Vehicle, at its discretion, for the purpose of generating funds for its charitable programs.

Vehicle Valuation and Tax Deductions

3.1 The Donor understands that the Organization does not provide appraisals or valuations of donated Vehicles, and it is the Donor’s responsibility to obtain a qualified appraisal, if required, for tax purposes.

3.2 The Donor acknowledges that it is their responsibility to comply with all applicable tax laws and regulations and to consult with their tax advisor regarding any potential tax deductions resulting from the Vehicle donation.

Vehicle Condition and Representations

4.1 The Donor represents and warrants that the Vehicle is in the condition described at the time of donation.

4.2 The Donor acknowledges that the Organization has not conducted an inspection of the Vehicle and accepts the donation in its present condition, “as is,” without any warranties or guarantees.

Release of Liability

5.1 The Donor agrees to release and hold harmless the Organization, its officers, employees, and agents from any liability, including but not limited to claims, damages, or losses arising from the use, possession, or operation of the Vehicle after the transfer of ownership.

Indemnification

6.1 The Donor agrees to indemnify and defend the Organization, its officers, employees, and agents against any claims, actions, or demands arising out of or related to the donation of the Vehicle, including but not limited to claims of ownership, liens, or encumbrances.

Governing Law and Jurisdiction

7.1 This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction]. Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].

Entire Agreement

8.1 This Agreement constitutes the entire agreement between the Donor and the Organization regarding the donation of the Vehicle, superseding any prior agreements or understandings, whether written or oral.

By donating the Vehicle, the Donor acknowledges that they have read, understood, and agreed to these Terms and Conditions.
